USER AGREEMENT (PUBLIC OFFER) FOR NAKEDTRUTH.SHOP ONLINE STORE
This Public Offer is an official proposal from the Seller, addressed to an unlimited number of individuals, to conclude a retail sale and purchase agreement for Goods remotely.
1. Terms and Definitions
Seller, Online Store nakedtruth.shop — FOP Vovk Nataliia Viktorivna — a business entity established in accordance with the legislation of Ukraine, which carries out the sale of Goods remotely, including using information and telecommunication networks "Internet" via the Online Store at the address: nakedtruth.shop.
User — an individual who uses the Website services, certain Website functions.
Buyer — an individual who intends to purchase Goods solely for personal, family, household, and other needs unrelated to entrepreneurial activity.
Distance Sale of Goods — the sale of Goods based on a retail sale and purchase agreement, which is concluded based on the Buyer's familiarization with the description of the Goods, terms of payment, delivery, and warranty offered by the Seller, contained on the Online Store website. The agreement is considered concluded from the moment the Buyer completes the Order placement procedure — the Buyer's acceptance of this Public Offer.
Confirmation of Agreement Conclusion — the issuance of a cash or commercial receipt or other document by the Seller that confirms payment for the Goods to the Buyer.
Online Store (Website) — a resource belonging to the Seller, located on the "Internet" network at the address: nakedtruth.shop.
Personal Account — the personalized interface of the Website with a set of tools for the User.
Order — an electronic or any other request/application from the Buyer for the purchase of Goods from the assortment of the Online Store.
Goods — products (clothing, lingerie, accessories, etc.), information about which is posted on the Website.
Services — a set of measures carried out by the Online Store to execute the retail sale and purchase agreement (delivery, informing, etc.).
2. General Provisions
2.1. The information posted in the nakedtruth.shop Online Store on the Website contains the terms of the offer to purchase the Goods and constitutes a Public Offer, in accordance with Part 2 of Art. 11 of the Law of Ukraine "On E-commerce" and Art. 641 – 643 of the Civil Code of Ukraine.
2.2. The moment of the Buyer completing the Order placement procedure in the Online Store is considered the Acceptance (acceptance) of the Public Offer.
2.3. The Seller has the right to change this Public Offer without special notification. The new version comes into force from the moment it is posted on the nakedtruth.shop Website.
2.4. The Online Store is governed by the provisions of the Civil Code of Ukraine, the Law of Ukraine "On Consumer Rights Protection," the Law of Ukraine "On E-commerce," and other regulatory acts.
2.5. The Buyer and the Seller guarantee the necessary legal capacity and competence to conclude and execute this offer. The Parties are responsible for the inaccuracy of the information provided.
3. Goods and Purchase Procedure
3.1. The photographs accompanying the Goods are illustrations and may differ from the actual appearance of the Goods (color, shape, size, etc.) due to the features of the User's screen or minor changes by the manufacturer.
3.2. The price of the Goods is indicated in the national currency of Ukraine – Hryvnia (UAH). The Goods are reserved for the Buyer only after the Order is processed by the Online Store.
3.3. Warranty periods for the Goods are determined in accordance with the legislation of Ukraine. The Buyer may contact Customer Support for additional information about the Goods.

3.5. An Order can be placed by:

independently moving the Goods to the "cart";

creating a request on social networks or messengers specified on the website.
3.6. In case of absence of the ordered Goods, the Seller has the right to exclude such Goods from the Order, notifying the Buyer about it.
4. Delivery or Receipt of Goods
4.1. The method, terms, and cost of delivery are indicated on the Website in the "Delivery and Payment" section.
4.2. The territory of Goods delivery is limited to the territory of Ukraine, excluding temporarily occupied territories.
4.3. Upon delivery, the Order is handed over to the Buyer or the person specified in the Order as the Recipient.
4.4. The risk of accidental loss or accidental damage to the Goods transfers to the Buyer from the moment the Goods are handed over to them and the Recipient affixes a signature in the documents confirming the receipt of the Goods.
4.5. The Recipient is obliged to inspect the Goods upon receipt and check them for compliance with quantity, assortment, completeness, and packaging integrity.
5. Payment for Goods
5.1. Prepayment on the website. Upon making a prepayment, the Seller sends the Buyer an electronic receipt to the email address.
6. Refusal of Goods, Return of Goods and Funds
6.1. The Buyer has the right to refuse the Goods at any time before their transfer, and after the transfer of the Goods — in the manner and within the terms specified in the Website section "Exchanges and Returns."
6.2. ATTENTION: In accordance with Appendix No. 3 to the Resolution of the Cabinet of Ministers of Ukraine No. 172 of March 19, 1994, Goods of proper quality presented in the assortment of the nakedtruth.shop Online Store (including underwear, swimwear, corsetry products, hosiery products) are not subject to exchange (return).
6.3. The return of Goods of improper quality (with identified defects or flaws) is carried out in the manner provided for in the Website section "Exchanges and Returns" and the Law of Ukraine "On Consumer Rights Protection."
6.4. If the Buyer refuses to receive the Goods, the Seller returns the amount paid, excluding the Seller's costs for delivery (return) of the unreceived Goods.
6.5. The refund is made by the same method used for the payment, no later than 10 days from the date the Seller received the returned Goods and confirmed the reason for the return (defect/error in case of return of poor quality goods) or the date of refusal to receive the goods.
7. Confidentiality and Information Protection
7.1. The User's/Buyer's personal data are processed in accordance with the Law of Ukraine "On Personal Data Protection."
7.2. By providing their personal data, the User/Buyer agrees to their processing by the Seller, including for the purpose of fulfilling obligations under this Public Offer.
7.3. The Seller undertakes to prevent attempts at unauthorized access to information and has the right to record telephone conversations with the Buyer.
8. Term of the Public Offer
This Public Offer comes into force from the moment of its acceptance by the Buyer and is valid until the full fulfillment of obligations.
9. Additional Conditions
9.1. The legislation of Ukraine applies to the relations between the User/Buyer and the Seller.
9.2. All disputes will be sought to be resolved by the parties through negotiations; if an agreement is not reached, the dispute will be submitted for consideration in accordance with the current legislation of Ukraine.
